Yousel Lopez Rivera, 21, has been charged with attempted first-degree murder of a police officer.
David Brener, who is representing Rivera, filed a motion to block the video’s release to prevent adverse pre-trial publicity that could make seating a jury difficult.
The video shows Officer David Wagoner stopping a black Cadillac with an expired tag on Santa Barbara Boulevard around 12:30 a.m. April 16. After talking briefly with the driver, he walks around to the other side of the vehicle to talk to the passenger, at which point a gun can be seen poking out the window and firing three shots into Wagoner from a few inches away.
Wagoner sticks his arms out before falling back and rolling onto the sidewalk. He lifts himself to his knees and fires seven shots at the fleeing vehicle.
“I’m hit Cape. I need a medic. Black Cadillac heading north. White male, purple shorts,” he tells dispatch.
Three witnesses leave their vehicles to check on Wagoner, asking him if he’s OK and where he is hit. “I’m not sure,” he says. “I don’t want to look at this point.”
Two of the bullets lodged in his bulletproof vest while a third slipped beneath the vest and tore through his abdomen.
